ALO ARK · Copyright & IP Policy
Part of the ALO ARK Terms of Service · Contact for all notices: copyright@aloark.com
ALO ARK hosts content uploaded by members: profiles, work samples, and project listings. We respect intellectual property rights and expect members to do the same: upload only work you have the right to share.
United States: DMCA notice & takedown
If you believe content on ALO ARK infringes your copyright, send a notice containing the elements required by 17 U.S.C. §512(c)(3):
- Your physical or electronic signature;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the infringing material and information reasonably sufficient to locate it (a URL);
- Your contact information (address, phone, email);
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner.
Designated agent: Sian Reid, ALO ARK, 3909 University Ave NW, Suite 1060, Calgary, AB T3B 6K3, Canada · copyright@aloark.com (email preferred) (Registered with the U.S. Copyright Office DMCA Designated Agent Directory, Registration No. DMCA-1076169. Designated agent: Copyright Agent, Alo Ark Technologies Inc.)
On receiving a valid notice we will remove or disable access to the identified material promptly and notify the member who posted it.
Counter-notice: if your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice with the elements of §512(g)(3) (signature; identification of the removed material and its prior location; a statement under penalty of perjury of good-faith belief the removal was mistaken; your contact information and consent to jurisdiction). If the original claimant doesn't inform us of a court action within 10–14 business days, we may restore the material.
Repeat infringers: we track validated infringement notices per account. An account that accumulates repeated validated notices (ordinarily three within 12 months, assessed with judgment; counter-noticed and withdrawn claims don't count) will be terminated. We may terminate faster for flagrant cases.
Canada: notice and notice
Under Canada's Copyright Act notice-and-notice regime, if we receive a compliant notice of claimed infringement regarding content or activity on ALO ARK, we will forward the notice to the member concerned as soon as feasible and retain records identifying the member for six months (or one year if court proceedings are commenced). We are not permitted to charge a fee for forwarding.
A compliant Canadian notice must be in writing and include: the claimant's name and address; identification of the work and the claimant's interest or right in it; the location data of the allegedly infringing content; the infringement claimed; and the date and time of the claimed infringement.
Note: Canadian law does not require content removal on notice alone, but ALO ARK's Terms of Service independently allow us to remove content that infringes others' rights, and we will act on clear cases.
Trademark & impersonation
If a member's profile, project listing, or content misuses your trademark or impersonates you or your company, email copyright@aloark.com with the mark or identity concerned, where it appears (URL), and the basis of your rights. Impersonation of real people or companies violates our Terms of Service regardless of trademark registration and will be removed.
A note on fair use / fair dealing
Some uses of copyrighted material are lawful without permission: fair use in the US and fair dealing in Canada (e.g., limited quotation, review, education). Before filing a notice, consider whether the use qualifies; misrepresenting infringement in a DMCA notice can carry liability under §512(f).
Records
We log all notices, forwards, takedowns, counter-notices, and outcomes. Canadian identity records are retained six months (twelve if proceedings commence), per the notice-and-notice regime.
